An agency adoption is arranged through an agency that helps to place a child into your care. This will usually involve a local department of social services. There are two types of agencies - public and private. Both have distinct differences.
If you go through a public agency alot of it is funded via tax dollars. Children in a public agency are usually there because they have been removed from their parent due to abuse or neglect.
The adoption agency will usually monitor and follow-up to see how the adoption is going for the first 6 months of placement with the new adoptive parents.
If you go privately there may be more fees involved, as these agencies rely alot on donations and fees. Children at private agencies are usually voluntarily handed over by the birth-parent for various reasons.
Getting Legal Guardianship
Legal guardanship is handed over to the adoption agency by the birth-parent through a consent form they sign. The parent/s have 30 days to try and revoke it if they want the child back. If you already have a birth-mother organised, you can do an independent adoption, or private adoption.
In the instance the birth-father ignores the court order, his parental rights become terminated as the court views his decision to ignore the order as failure to respond.
the father or the other parent who didn't give the initial consent can file an objection to the guardianship.
It's not often that the other parent does do this, but it can and does happen sometimes. In this event you will work out an arrangement between yourself and the birthparents, or the adopting parents if you are the birth-mother.
